Makes contracts unenforceable if they fail to include required data practices terms clarifying that all data created, collected, received, stored, used, maintained, or disseminated by a private contractor is subject to state data practices requirements.

Requires state agency contracts to mandate that contractors submit copies of any subcontracts to the agency upon request, with mandatory submission required if an individual requests the document from the agency.

Requires municipalities to include contract provisions mandating contractors submit subcontract copies upon request, with mandatory submission if an individual requests the document from the municipality.

Requires state agencies and municipalities to maintain fully executed copies of contracts, subcontracts, amendments, and performance evaluations as public records under Minnesota Statutes sections 15.17 and chapter 138.

Effective August 1, 2014, applying to state contracts entered into on or after that date.
