HF2008 Summary

• Grants the Commissioner of Transportation authority to suspend or debar persons from receiving Department of Transportation contracts based on convictions for criminal offenses related to contract performance, embezzlement, theft, forgery, bribery, and antitrust violations.

• Establishes "responsible person" definition requiring contractors to demonstrate adequate equipment, skills, financial capability, satisfactory credit standing, compliance with tax laws, and no record of contract performance failures or unlawful practices.

• Allows the Commissioner to suspend contractors for up to six months or debar for up to three years based on contract violations, false information, collusion, threatening behavior, or debarment by other government entities, with suspension/debarment extending to affiliated businesses and principals.

• Requires written notice of proposed suspension or debarment specifying reasons and allowing 30 days for written response or request for hearing, with appeal rights to the Commissioner within 30 days of the designee's initial order.

• Mandates the Commissioner publish a public list of suspended and debarred persons on the Department website and notify the Commissioner of Administration of all suspension and debarment orders.
