Prohibits operating a motor vehicle while using a handheld wireless communications device to compose, read, or send electronic messages or make cellular phone calls when the vehicle is in motion or part of traffic.

Allows exceptions for hands-free mode use, emergency assistance to report accidents or prevent crimes, situations where a person's life or safety is in immediate danger, and authorized emergency vehicles performing official duties.

Establishes a $100 fine for first violation and classifies it as a petty misdemeanor.

Increases fine to $200 for a second violation and $300 for a third or subsequent violation within the same time period.

Classifies three or more violations within a two-year period as a misdemeanor offense.
