Authorizers must file affidavits with the commissioner stating intent to charter a school, with separate affidavits required for each school.

Commissioner has 60 business days to approve or disapprove affidavits; if disapproved, authorizer has 20 business days to address deficiencies and commissioner has 10 days to approve or disapprove the reply.

Charter school boards must have at least five nonrelated members including at least one licensed teacher, one parent or guardian of an enrolled student, and one community member.

All new board members must complete initial training within 12 months of being seated and attend annual training throughout their term, or become automatically ineligible to serve.

Authorizers seeking to expand charter schools to additional sites or grades must submit supplemental affidavits demonstrating student academic performance, financial soundness, and management capacity, with commissioner approval required before expansion.
