Voids and makes unenforceable any provision in design professional services contracts that requires indemnification for losses or damages caused by negligence or fault of anyone other than the indemnitor or those they are legally liable for.

Applies to contracts where a person licensed under section 326.02 performs or supervises work related to maintenance or improvement of real property, highways, roads, or bridges.

Does not apply to indemnification obligations that can be covered by insurance or to agreements covered under sections 337.03 or 337.04.

Voids any provision in Minnesota design professional services contracts that subjects the contract to another state's laws or requires litigation, arbitration, or dispute resolution to occur outside Minnesota.

Effective August 1, 2014, and applies to contracts or agreements entered into on or after that date.
