Programs accredited by Association Montessori Internationale/USA serving children ages 8 weeks through age 5 are exempt from licensing under chapter 245A if approved by the commissioner of education.

Approved programs must submit a three-year plan, provide current accreditation documentation, comply with state and local fire codes, follow specific Minnesota Rules sections, and confirm criminal background checks for all employees, volunteers, and contractors.

Commissioner of education must request criminal history background checks from the Bureau of Criminal Apprehension for all individuals offered employment, with fingerprints and fees required from applicants.

Commissioner has unannounced right of access to approved programs' facilities, records, and staff to investigate plans, reports, alleged maltreatment, and compliance with legal requirements.

Adds Montessori early childhood programs approved under this section to the list of programs exempt from licensing requirements under Minnesota Statutes section 245A.03.
