Road authorities may not maintain holding ponds (detention or retention ponds) within road rights-of-way unless the pond has a maximum depth of three feet following peak discharge from weather events, or is separated from adjacent roadways by a cable median barrier or other traffic barrier capable of preventing motor vehicle entry at typical road speeds.

Road authorities must comply with the new holding pond requirements by November 1, 2015, for any holding ponds established before this bill's effective date.

The bill takes effect the day following final enactment.
