Transfers guardian duties for developmentally disabled persons from the State Board of Control and director of social welfare to the commissioner of human services.

Removes outdated language from section 246.01 that previously required the commissioner to accept marriage applications and conduct investigations for wards with developmental disabilities.

Establishes new procedures in section 252A.111 requiring the commissioner to grant consent to marriage unless investigation shows the civil marriage is not in the best interests of the ward and the public.

Requires local registrars to obtain signed consent from the commissioner of human services before issuing a marriage license when the commissioner has guardianship powers over a developmentally disabled person.
