Commissioner of human services must provide 30 calendar days' written notice to affected municipalities before issuing a license for residential or nonresidential programs.

For programs considered permitted single-family or multifamily residential/nonresidential uses, notice must be given 30-45 days before signing a purchase or lease agreement, with written notification to all residences, schools, churches, community organizations, and businesses within 2,640 feet of the facility.

A public hearing must be held in the community 14-21 days before signing a purchase or lease agreement for group homes or treatment facilities.

Notification requirements apply to both state-operated and nonstate owned or operated programs.

State funds cannot be used for payment to any licensed residential or nonresidential program until notification requirements are fully complied with, except for programs located in hospitals.
