Commissioner of Human Services must adopt rules by August 31, 2015 governing positive support strategies, emergency manual restraint use, and restricting or prohibiting aversive and deprivation procedures in all facilities and services licensed under chapter 245D and serving persons with developmental disabilities or related conditions.

Commissioner must identify data collection elements for incidents of emergency manual restraint and positive support transition plans, with licensed facilities and services required to report data to the commissioner and Office of the Ombudsman for Mental Health and Developmental Disabilities in a format and frequency determined by the commissioner.

Rules must establish requirements for an external program review committee appointed by the commissioner to monitor compliance after rule adoption.

Commissioner must establish an interim review panel by August 15, 2014 to review requests for emergency use of procedures in approved positive support transition plans when necessary to protect persons from imminent serious injury due to self-injurious behavior; panel operates until external program review committee is established.

Repeals multiple existing statutes and Minnesota Rules sections related to controlled procedures and safety interventions upon the effective date of new rules adopted under section 245.8251.
