Adds "defend" to the definition of "indemnification agreement" in building and construction contracts, expanding what constitutes an indemnification obligation.

Voids provisions in contracts that require a party to provide insurance coverage for the negligence or intentional acts of other parties, including third parties, as against public policy.

Preserves validity of provisions requiring workers' compensation insurance, construction performance/payment bonds, builder's risk policies, and owner or contractor-controlled insurance programs.

Preserves validity of provisions requiring insurance coverage for the promisee's vicarious liability or warranty-based liability arising from the promisor's own acts or omissions.

Exempts building and construction contracts for work within 50 feet of public or private railroads from the insurance coverage restrictions.
