Commissioner shall establish rules for calculating average cost of care for domiciliary and nursing care residents separately, considering administrative costs, services, food, and lodging expenses.

Maintenance charges for each resident must be based on the appropriate average cost of care calculation and the resident's assets and income, but cannot exceed the calculated average cost.

Personal needs allowance for domiciliary residents shall be set at minimum $114 per month for January 1, 2015, to December 31, 2015, with commissioner to recommend future adjustments in biennial budget requests.

Residents may continue staying in homes while owing overdue maintenance charges if they enter into a payment agreement with the administrator, provided the payment schedule does not reduce their personal needs allowance below the amount specified in subdivision 2.

Removes language limiting interest charges on overdue maintenance to charges incurred after May 1, 1990, allowing interest to be charged on all overdue maintenance according to statute 334.01.
