Requires physicians to determine probable postfertilization age before performing an abortion, except in medical emergencies, and mandates documentation of the determination method and basis for exceptions on state reporting forms.

Establishes criminal felony penalties for physicians who intentionally or recklessly violate the abortion restrictions, while prohibiting penalties against the woman receiving the abortion.

Creates civil liability allowing the pregnant woman or father of the unborn child to sue for damages and injunctive relief against providers who violate the law, with prevailing plaintiffs entitled to attorney fees.

Creates a litigation account in the special revenue fund to pay for attorney general legal costs defending the act against legal challenges, funded through legislative appropriations and private donations.
