• School boards and hiring authorities must request that expunged criminal records be unsealed and must review the content before hiring a prospective employee if a background check reveals an expunged record.

• School districts must require teacher applicants to disclose all current and previous disciplinary actions against their teaching license in Minnesota and other states, and the existence of any expunged criminal conviction records.

• Expunged criminal conviction records may be opened for purposes of a background check of prospective school employees under Minnesota Statutes 123B.03, subdivision 1, without a court order.

• The effective date is the day following final enactment and applies to all individuals applying for employment as a teacher after that date.
