Business entities are prohibited from collecting personal identification information (address, zip code, telephone number, email address) during credit card transactions unless required by the credit card issuer or requested for security purposes.

Collected personal identification information cannot be used for promotional or marketing purposes or to solicit business from the credit card holder.

Exception allows collection of personal information for business activities unrelated to credit card transactions, such as shipping, delivery, or warranty registration.

Violating businesses are liable to consumers in civil actions for all money collected, actual and consequential damages, statutory damages up to $1,000 per violation, costs and attorney fees, and injunctive relief.

Effective date is August 1, 2015, for all credit card transactions occurring on or after that date.
