Commissioner of Human Services must apply for a federal innovation waiver under section 1332 of the Affordable Care Act to allow MinnesotaCare enrollees to decline coverage and access advanced premium tax credits and cost-sharing reductions instead

Eligible persons may purchase qualified health plans through MNsure or directly from health plan companies using the tax credits and cost-sharing reductions

Commissioner must submit the federal waiver request within 120 days of the effective date and coordinate with the waiver request required by Laws 2015, chapter 71, article 12, section 8

Commissioner must submit a draft waiver proposal to the MNsure board and MNsure Legislative Oversight Committee at least 30 days before submitting the final proposal to the federal government

Commissioner must notify the board and Legislative Oversight Committee of any federal decision or action related to the proposal
