County boards may adopt a no-net-gain policy for state-owned land within their county by resolution and must submit the resolution to the commissioner of natural resources.

The commissioner of natural resources must compile and maintain a list of counties that adopt no-net-gain policies and publish this list on the Department of Natural Resources website.

State agencies cannot enter into agreements to acquire real property in counties with adopted no-net-gain policies unless the county board approves the acquisition.

County boards may require that an equal amount of state-owned land administered by the commissioner of natural resources be offered for public auction as a condition of approving fee property acquisitions.

If the state seeks to acquire county-owned land, the county may require an acre-for-acre exchange of public land of equal value, with land conveyed to the county in exchange sold before title vests in the state.
