School board vacancies must be filled by board appointment at a regular or special meeting, evidenced by a resolution in the minutes.

If a vacancy occurs before the candidacy filing deadline and more than two years remain in the unexpired term, a special election shall be held with the school district general election.

If a vacancy occurs on or after the candidacy filing deadline or when less than two years remain in the unexpired term, no special election is held and the appointed person serves the remainder of the unexpired term.

Repeals existing statutes (123B.09, subdivision 5a and 123B.095) that previously allowed school boards to choose between special elections or appointments to fill vacancies.

For elections previously called under the repealed law but not yet held, school boards may cancel those elections and fill vacancies by appointment upon adopting a resolution.
