• Prohibits school employees and device providers from accessing, tracking, or analyzing data on student 1-to-1 devices (computers/tablets provided for home use) except for specific authorized purposes including teacher educational use, reasonable suspicion of policy violations, or imminent threats to safety.

• Requires judicial warrants before accessing devices when illegal conduct is suspected, and limits searches for policy violations to evidence directly related to the specific suspected violation.

• Bans use of location tracking technology on devices except pursuant to judicial warrant, when device is reported missing/stolen, or in response to imminent threats to life or safety, with 72-hour notification requirements.

• Prohibits school employees and device providers from accessing audio/video functions, password-protected accounts, or using student data for marketing/advertising without valid opt-in agreements signed by parents (elementary students) or students and parents (secondary students).

• Establishes penalties including civil damages, attorney fees, and disciplinary action for violations; makes improperly obtained evidence inadmissible in legal proceedings; effective January 1, 2017.
