Establishes a regulatory certainty incentive for municipalities and industrial permit holders that voluntarily install biological nutrient removal systems using public funds to remove nitrogen and phosphorus from wastewater.

Grants exemption from new permit limits for phosphorous or nitrogen after initial permit issuance for a period up to 20 years, contingent on proper system maintenance and operation.

Requires the Pollution Control Agency commissioner to determine eligibility and execute an agreement with applicants before finalizing their NPDES/SDS permits, with the agreement incorporated into the permit.

Limits each wastewater treatment facility to receiving regulatory certainty only once and requires continued compliance with applicable Minnesota Rules chapter 7001 provisions.

Sunsets the application period on December 31, 2031, or upon U.S. Environmental Protection Agency approval of a Minnesota total nitrate-nitrogen aquatic life water quality standard, whichever occurs first, though existing agreements remain in effect for their stated terms.
