Individuals aged 55 to 64 who received non-institutional medical assistance may provide written notice of disenrollment to the Commissioner of Human Services.

Commissioner must calculate the amount of medical assistance correctly paid on behalf of the former recipient within 60 days of receiving the disenrollment notice.

Commissioner shall offer the former recipient the opportunity to remit the calculated amount to the state.

Upon receipt of payment, the commissioner must fully release any notice of potential claim or lien and provide written confirmation to the former recipient.

Effective retroactively from January 1, 2014.
