Metropolitan Council must not impose sewer availability charges (SAC) on eating or drinking establishments for outdoor seating additions or expansions unless the establishment also increases fixtures discharging into the sanitary sewer system or increases sanitary sewer pipe capacity.

If fixtures or pipe capacity increases occur, the SAC charge must be proportionate to the actual increase in demand on the sanitary sewer system.

"Eating or drinking establishments" are defined as coffee shops, bars, restaurants, and similar businesses that serve food or beverages to customers on site.

Effective for sewer availability charges imposed on or after August 1, 2016 in Anoka, Carver, Dakota, Hennepin, Ramsey, Scott, and Washington counties.
