Materials and supplies used in and equipment incorporated into a water treatment facility owned and operated by the city of Elko New Market are exempt from sales tax under Minnesota Statutes, chapter 297A.

Eligible purchases must be made after July 1, 2016, and before January 1, 2018.

Tax on exempt purchases is imposed and collected, then refunded according to Minnesota Statutes section 297A.75, with the city of Elko New Market as the refund applicant.

City may apply directly to the commissioner of revenue for refunds on sales tax paid prior to the effective date, with contractors required to provide statements documenting exempt items and taxes paid.

Interest accrues on refunds at the rate specified in Minnesota Statutes section 270C.405 beginning 90 days after the refund claim is filed, and funds are appropriated to the commissioner of revenue to make refunds.
