Counties pay the state a percentage of care costs for clients at regional treatment centers or state nursing facilities: zero percent for first 30 days, 20 percent for days 31 and over if clinically appropriate, and 100 percent when facility determines discharge is clinically appropriate.

Counties can avoid the 100 percent reimbursement rate if they establish a separate account for community-based mental health services and deposit 80 percent of applicable care costs into that account.

Counties using the exemption must use deposited funds to develop local community-based services for discharged individuals and preventive services to avoid inpatient treatment, and must issue annual reports to the commissioner on fund usage.

Different payment rates apply to Minnesota Security Hospital (10 percent for regular services, 50 percent for forensic transition service) and sexual psychopathic personalities or sexually dangerous persons are exempt from subdivision 1 requirements.

Funds in the special account must supplement, not replace, existing community-based mental health service funds.
