Commissioner shall conduct background studies of individuals required to be studied upon application for initial enrollment in personal care provider organizations under specified statute sections.

Personal care provider organizations must submit completed background study requests through the NETStudy electronic system before individuals begin positions allowing direct contact with persons served.

Organizations must initiate a new background study through NETStudy when an individual returns to a background study position following an absence of 120 or more consecutive days.

Individuals may provide personal care assistance before background study completion only if providing assistance in an emergency situation and a background study was previously successfully completed by a different personal care provider organization.

Organizations remain obligated to initiate background studies regardless of prior successful completion at other organizations.
