H.F. No. 788 Summary

• Requires clinics, health centers, and other facilities performing 10 or more abortions per month to obtain a license from the Commissioner of Health under Minnesota Rules chapter 4675.

• Establishes an annual licensing fee of $3,712 for facilities required to be licensed under this section.

• Authorizes the Commissioner of Health to conduct routine and comprehensive inspections up to two times per year without prior notice.

• Makes operation of an unlicensed facility a misdemeanor punishable by a fine of not more than $300, and allows the Commissioner, Attorney General, county attorney, or a woman who had an abortion at an unlicensed facility to seek an injunction to stop operations.

• Appropriates $63,000 in fiscal year 2016 from the state government special revenue fund to the Commissioner of Health for implementing the licensing program.
