Requires the Department of Commerce to determine whether non-utility cogeneration facilities that are large electric power generating plants will result in net reduction of carbon dioxide emissions, considering both utility emissions and customer thermal energy efficiency gains.

Defines "cogeneration facility" or "combined heat and power facility" by reference to United States Code, title 16, section 796, clause (18), paragraph (A), and requires compliance with federal operating and efficiency standards in Code of Federal Regulations, title 18, part 292.205.

Excludes cogeneration facilities or combined heat and power facilities from the definition of "new large energy facility" for purposes of Minnesota Statutes section 216H.03, along with natural gas primary fuel facilities and certain peaking or backup service facilities using simple or combined cycle turbine technology.

All provisions effective the day following final enactment.
