School districts must obtain prior written informed consent from parents or guardians before administering surveys or assessments to minor or dependent children that solicit information about political affiliations, mental/psychological problems, sexual behavior, illegal activity, family relationships, privileged relationships, religious practices, or income-related information.

School districts must make the survey instrument readily accessible to parents or guardians at a convenient location and time, and specifically identify what sensitive information will be solicited.

School districts must request parental consent at least 14 days before administering the instrument.

Parents or guardians can use civil remedies under Minnesota Statutes section 13.08, subdivision 4, to compel school district compliance, in addition to other available legal remedies.

The law takes effect the day following final enactment.
