Creates new statute (section 540.121) providing that injury causes of action do not abate upon death or disability of a party if the action was commenced before that death or disability.

Allows personal representatives or successors in interest of a deceased party to pursue or defend the cause of action to settlement or final judgment.

Does not create a right for next of kin to sue for their own pain and suffering from another's wrongful death; wrongful death damages under section 573.02 remain unaffected.

Amends section 573.01 to reference the new section 540.121 as an exception to the rule that injury causes of action die with the person.

Effective August 1, 2015, and applies to actions commenced on or after that date.
