Drivers who fail to comply with work zone flagger instructions or traffic control devices are guilty of a petty misdemeanor and must pay a $300 fine plus surcharge.

Drivers convicted of speeding or other violations while in a work zone must pay a $300 fine in addition to applicable surcharges.

Vehicle owners and lessees can be held liable for work zone violations if the vehicle is operated in violation, unless another person is convicted or the vehicle was stolen, and lessors are exempt if they maintain lessee records.

Peace officers may stop and issue citations to drivers if they have probable cause to believe the driver violated work zone rules within the preceding four hours.

The law becomes effective August 1, 2016, and applies to violations committed on or after that date.
