SF2132 Summary

• Creates new section 144.2253 establishing that adopted persons age 18 and older can request and receive noncertified copies of their original birth records from the state registrar without restrictions if no affidavit of nondisclosure is on file.

• Allows birth parents to file affidavits of nondisclosure with the Office of Vital Records to prevent disclosure of their identifying information; affidavits are automatically rescinded upon the birth parent's death or can be voluntarily rescinded at any time.

• Establishes a contact preference form that birth parents may file with the Office of Vital Records to indicate whether they want contact from the adopted person, contact through a designated intermediary, or no contact.

• Provides adopted persons whose original birth records are subject to affidavits of nondisclosure the right to petition district court for an order to rescind the affidavit and authorize release of the birth record under sections 259.61 and 259.89, subdivision 5a.

• Appropriates unspecified funding for fiscal year 2017 to the Commissioner of Health to provide information and educational materials to adopted persons and birth parents about the legal changes; effective January 1, 2018.
