SF2153 Summary

• Amends Minnesota Statutes 2015 Supplement, section 628.26, to modify criminal statute of limitations for violations of section 626.556, subdivision 6 (failure to report child abuse/endangerment by mandated reporters).

• Extends statute of limitations to the later of 9 years after the person mandated to report fails to make the required report, or 3 years after the failure is discovered by law enforcement authorities.

• Applies definitions of "physical abuse," "sexual abuse," and "substantial child endangerment" from section 626.556, subdivision 2, with specific limitations on what constitutes reportable conduct.

• Effective August 1, 2016, and applies to crimes committed on or after that date and to pre-August 1, 2016 crimes if the limitations period had not already expired.
