Establishes restrictions on school employees' and 1-to-1 device providers' access to student data on devices provided by educational institutions, allowing access only for non-personally identifiable information, educational purposes, valid opt-in agreements, policy violations with documentation, illegal conduct with judicial warrant, software updates, cybersecurity protection, imminent safety threats, or publicly posted information.

Prohibits use of location tracking technology on student devices except pursuant to judicial warrant, when device is reported missing or stolen, or in response to imminent life or safety threats requiring 72-hour written notification.

Bars school employees from activating audio or video functions on student devices except when student initiates contact, per judicial warrant, or for imminent safety threats; prohibits access to password-protected accounts except for teachers reviewing educational content.

Requires valid opt-in agreements to specify which student data can be accessed, who accesses it, and the educational purpose, with different signature requirements based on student age; prevents conditioning device access on agreement to provide student data and requires 30-day notice to third parties upon agreement revocation.

Violations subject to civil liability for actual damages including mental pain and suffering, attorney fees, and disciplinary proceedings for school employees; evidence obtained in violation is inadmissible in legal proceedings; effective January 1, 2017.
