Home rule charter or statutory city councils and town boards may exempt adjoining owners or occupants from fence-viewing requirements when their combined land is less than 20 acres, effective immediately upon enactment.

When eight or more landowners petition for a vote on partition fence policy, the governing body may adopt its own policy and procedures for dealing with partition fences, including enforcement procedures.

Adopted partition fence policies must be approved by town electors at an annual or special town meeting, in which case state fence-viewing law does not apply in that town.

State fence-viewing law applies to partition fences on boundaries between political subdivisions only if at least one subdivision has adopted its own partition fence policy and the other has not adopted a similar policy.

Both sections are effective the day following final enactment.
