MNsure may retain or collect up to 3.5 percent of total premiums from individual and small group health and dental plans through December 31, 2016, capped at 100 percent of 2012 baseline funds collected under section 62E.11, subdivision 6.

Beginning January 1, 2017, MNsure may retain 1.75 percent of premiums if the Office of the Legislative Auditor certifies it met five operational and technological benchmarks including daily EDI 834 data transfers, automatic enrollment renewals, MinnesotaCare premium processing, self-service account changes, and call center response standards.

If the Legislative Auditor does not certify MNsure met benchmarks in the previous year, MNsure may retain only 1.5 percent of premiums for that calendar year.

Total annual collections by MNsure cannot exceed 60 percent of the funds collected under section 62E.11, subdivision 6, for calendar year 2012.

Navigator program compensation must be covered within MNsure operations funding.
