Commissioner of Human Services must review and evaluate the applicability of Minnesota Rules chapter 9544 (positive support strategies and restrictive interventions rules) to child care programs by December 31, 2016, considering undue hardship including increased costs and reduction in services.

Commissioner must submit a written plan to modify rule application for child care programs to the House and Senate committees with jurisdiction over child care by January 15, 2017.

Family day care, group family day care, and child care centers are temporarily exempt from part 9544.0040 (functional behavior assessment), except when a child has a case manager under section 256B.092, subdivision 1a, paragraph (e).

Family day care, group family day care, and child care centers are temporarily exempt from part 9544.0090 (staff qualifications and training).

Exemptions are effective the day following final enactment and remain in place until the commissioner completes the review and submits the written plan to the legislature.
