SF 3316 - Dry Cleaner Environmental Response and Reimbursement

• Redefines "owner or operator" of dry cleaning facilities to include persons who own or operate the facility, removing language that previously included property owners where facilities operate.

• Changes the annual expenditure limit for the dry cleaner response account from 20 percent of the account balance to a fixed $100,000 per facility per fiscal year.

• Transfers $743,000 from the general fund to the dry cleaner environmental response and reimbursement account in fiscal year 2017 for contaminated site remediation, conditioned on enactment of legislation addressing account insolvency.

• Requires the Pollution Control Agency to adopt rules defining reasonable environmental response costs, application requirements for reimbursement, and vendor payment adjustment processes, modeling rules after the petroleum tank response cleanup fund program.

• Repeals prior subdivision 9 definition of "owner or operator" and establishes effectiveness dates of the day following final enactment for all sections.
