Employers must grant paid leave of absence to employees undergoing medical procedures to donate bone marrow or an organ or partial organ to another person, with combined leave not exceeding 40 work hours unless the employer agrees otherwise.

Employees determine the length of leave needed, and employers may require physician verification of the donation purpose and leave duration.

Paid leave granted prior to a medical determination that the employee does not qualify as a donor is not forfeited.

This provision does not prevent employers from providing additional leave for bone marrow or organ donations beyond what is required, nor does it affect other employment benefits.

Repeals Minnesota Statutes 2014, section 181.9456 (previous organ donation leave law limited to public employers) and consolidates organ and bone marrow donation leave requirements under the same statute.
