Pharmacists may dispense legend drugs without a prescription if the patient has consistent drug therapy records, the original prescription has no refills remaining, the prescriber cannot be contacted, the drug is essential for life or chronic condition management, and dispensing failure would harm the patient.

Maximum dispensing amount is limited to a 30-day supply or the standard unit of dispensing for the drug, whichever is smaller.

Pharmacists may not dispense the same drug to the same patient more than once in any 12-month period under this provision.

Pharmacists must notify the prescribing practitioner within 72 hours after dispensing and maintain records in the same manner as prescription drug orders.

Health plans providing prescription drug coverage must cover drugs dispensed by pharmacists under this section using the same coverage terms as regular prescriptions.
