Designates excess spousal assets held in retirement accounts or college savings accounts for children under 25 as an undue hardship that cannot terminate an individual's eligibility for home and community-based waivered services.

Applies to individuals determined eligible for home and community-based waivered services under Minnesota Statutes 256B.092 or 256B.49 based on need for institutional level of care on or before May 31, 2016.

Prohibits any cause of action against the individual's spouse when eligibility is preserved under these provisions.

Becomes effective the day following final enactment.

Includes contingent repeal clause: the act is repealed 30 days after Centers for Medicare and Medicaid Services issues a disapproval, with notification required to the revisor of statutes.
