S.F. No. 3487 - Unborn Child Protection from Dismemberment Abortion Act

• Makes it unlawful for any person to purposely perform or attempt to perform a dismemberment abortion, except when necessary to prevent serious health risk to the mother's life or health.

• Defines "dismemberment abortion" as using clamps, forceps, tongs, scissors, or similar instruments to slice, crush, or grasp portions of a living unborn child's body, excluding suction-only procedures.

• Establishes criminal penalty of up to $10,000 fine and/or up to 2 years imprisonment for violations.

• Allows civil actions for damages by the woman, married father, or maternal grandparents (if woman is under 18 or deceased), including actual damages and statutory damages equal to three times the cost of the abortion, with attorney fees available to prevailing parties.

• Exempts women and medical support staff from liability, protects woman's privacy in proceedings through use of pseudonyms and sealed records, and permits abortion by other methods for any reason.
