Metropolitan Council must not impose sewer availability charges (SAC) on existing eating and drinking establishments due solely to addition or expansion of outdoor seating.

SAC charges may only be imposed if the establishment also increases the number or capacity of facilities using water and sanitary sewer systems, and the charge must be proportionate to that increase.

Defines "eating and drinking establishments" to include coffee shops, bars, restaurants, and similar businesses that serve food or beverages to customers on site.

Effective for sewer availability charges imposed on or after August 1, 2016, and applies in Anoka, Carver, Dakota, Hennepin, Ramsey, Scott, and Washington counties.
