Special review board must review each denied petition for barriers and obstacles preventing patient treatment progress, and provide the commissioner annual summation of barriers and recommendations to improve treatment outcomes.

Head of treatment facility must schedule a hearing before the special review board for any patient who has not appeared before the board in the previous three years, and schedule hearings at least every three years thereafter.

Documentary evidence submitted to the special review board prior to hearing must also be provided to the patient, patient's counsel, county attorney, case manager, and commissioner.

Special review board and commissioner must consider victim statements when making recommendations and orders regarding custody reduction or provisional discharge revocation.

Special review board composition remains three members with mental illness expertise, including one psychiatrist or doctoral psychologist with forensic experience and one attorney, with no Department of Human Services affiliation.
