Landowners or occupants with no need for a partition fence are exempt from building, maintaining, or paying for partition fence construction or maintenance costs.

A landowner or occupant has no need for a fence if their neighbor builds, maintains, or intends to build or maintain a partition fence to restrain livestock to the neighbor's property.

Disagreements about whether a fence is needed are resolved by a fence viewer under Minnesota Statutes section 344.06.

If a landowner or occupant's circumstances change to require a partition fence within seven years of construction, either party may request fence viewer re-evaluation and reassignment of construction and maintenance costs.

Repeals Minnesota Statutes section 383C.809, which previously applied the no-need exemption only in St. Louis County, extending this standard statewide effective August 1, 2017.
