HF 1338 Summary

• Districts shall seek reimbursement from insurers and third-party payers for special education services covered under a child's health insurance, beginning July 1, 2000.

• Districts must provide initial and annual written notice to parents of children enrolled in medical assistance or MinnesotaCare with no other health coverage regarding intent to seek reimbursement for evaluations and health-related services.

• Parents have the right to request copies of education records related to health services disclosed to third-party payers and may withdraw consent for record disclosure at any time without consequence.

• Districts must obtain annual written informed consent before accessing a child's private health care coverage and must inform parents that refusal to permit access does not relieve the district of its obligation to provide free and appropriate public education.

• Special education services covered by medical assistance include occupational therapy, physical therapy, speech-language pathology, psychological services, nursing services, assistive technology, and transportation, with all provisions effective August 1, 2017.
