School boards may include plans for up to 5 days of instruction provided through online instruction due to inclement weather in their annual school calendars.

"E-learning day" means a school day where schools offer full access to online instruction from students' individual teachers due to inclement weather, and districts or charter schools may have up to 5 e-learning days per school year.

School boards and teacher unions must agree to the district's e-learning day plan; charter schools may adopt plans after consulting with teachers, and plans must include accommodations for students without internet access and for students with disabilities.

Schools must notify parents and students of the e-learning day plan at the beginning of the school year and provide at least 2 hours' notice before declaring an e-learning day.

E-learning days count as days of instruction toward the required instructional hours and days, and teachers must be accessible both online and by telephone during normal school hours on e-learning days.
