Counties may adopt and file a "no net gain of state lands" policy with the Commissioner of Natural Resources expressing opposition to state acquisition of additional land within the county.

When the Commissioner acquires private land in fee using outdoor heritage fund money within a county that has filed a no net gain policy, the Commissioner must sell an equal number of acres of state land within that county to a private individual or entity.

Land sold must be of substantially equal value to the land acquired, as defined under Minnesota Statutes section 94.343, subdivision 3, paragraph (b).

If land offered for sale remains unsold after a public sale offering, it may be sold for less than appraised value but not less than 75 percent of the appraised value.

The county board adoption requirement in paragraph (a) is effective the day following final enactment.
