H.F. 1478 Summary

• Changes Minnesota Statutes 122A.40, subdivision 10 to require school boards and teacher bargaining representatives to must negotiate (rather than may negotiate) a plan for unrequested leave of absence due to position discontinuance, lack of pupils, financial limitations, or class consolidation.

• Adds new subdivision 14a to Minnesota Statutes 122A.41 imposing the same mandatory negotiation requirement for unrequested leave of absence plans in first-class cities.

• Removes the fallback provision that applied when parties failed to successfully negotiate, eliminating the default statutory framework previously outlined in subdivision 11.

• Repeals Minnesota Statutes 122A.40, subdivision 11 and 122A.41, subdivision 14, which contained detailed default rules governing teacher seniority, reinstatement rights, and provisional license restrictions.

• All changes are effective July 1, 2018.
