Commissioner shall approve on-site education programs for children and youth in residential facilities, detention centers, and mental health day treatment programs before licensing by Department of Human Services or Department of Corrections.

Commissioner must establish a process to approve education programs operated by care and treatment facilities, mental health day treatment programs, charter schools, or other educational institutions, with an appeal process including administrative law judge hearing.

All approved education programs must conform to state and federal education laws including the Individuals with Disabilities Education Act (IDEA).

Approved programs at specified facilities become the providing district or agency responsible for education services, including special education if eligible, for students placed in those facilities.

If no education program is approved at a facility, the district where the residential or mental health day treatment facility is located must provide education services to all students placed there.
