Municipalities may enter into multiyear professional service contracts for engineering, repair, and maintenance of water storage tanks through direct negotiation or request for proposals if the contract meets three specific conditions.

Contracts must include provisions limiting annual municipality payments to the water utility charges received that year and requiring work to be performed under review of a Minnesota-licensed professional engineer attesting compliance with applicable codes and standards.

Contractor must be responsible for providing engineering, repair, or service to bring noncompliant water tanks or facilities into federal, state, or local compliance, with compliance costs itemized separately and charged to the municipality over a minimum of three years.

If contract costs meet thresholds specified in subdivisions 3 and 3a (standard procurement requirements), municipalities must use standard procurement methods for that portion of the work rather than the negotiation exception.

Effective September 1, 2018, for contracts entered into on or after that date.
